Workshop Policy

WORKSHOP POLICY & GENERAL CONSENT 

In order to participate in the New York Society of Play’s Workshops, the Participant, by his/her parent/legal guardian, hereby consent and agree to all and each of the following terms:

1. Registration / Payment

Participant shall pay, within 24 hours following attendance, for each and every session of any Workshop Participant attends, whether it is an in-person event or an online Workshop with pre-registration on the website. In the event a session is attended without pre-payment or reservation, Participant understands and agrees that Participant shall be charged by New York Society of Play for these services by directly charging Participant’s credit card on file. In the event a Workshop (whether online or in person) is full, Participant understands and agrees that Participant will join a waitlist for said Workshop 48 hours before said session starts and Participant will receive updates if new seats become available. Alternatively, Participant can register for a different Workshop on a different date.

2. Registration / Billing

Participant grants the New York Society of Play permission to share Participant’s information with other companies only to the extent that such information is necessary for billing and registration purposes.

 

3. Cancellation / Refund Policy

All reservations have a grace period after purchase before the start of the second session. During the grace period, a full refund of the amount paid can be received upon cancellation. After this period, no refunds will be available except under special circumstances at the discretion of the New York Society of Play. 

If a Participant decides to leave mid-semester, Participant’s registration is canceled, and his/her spot is no longer reserved. A Participant may re-register based on availability at the time of re-registration.

 

4. Online Safety

This portion of our policy is applicable to all virtual classes, as well as our in-person programs that pivot online either as a hybrid option or due to a program closure.

Participant is familiar with the curriculum and the activities which take place in the New York Society of Play’s online courses and hereby wishes to participate in the New York Society of Play’s Workshops and assume all risks and hazards incidental to the New York Society of Play’s Workshop. Participant covenants that he/she will have at all times supervision of the Participant’s parent/legal guardian during his/her participation in the New York Society of Play’s Workshops.

Participants authorize this student to participate in live streaming video and audio communication with New York Society of Play employees and other students registered in the New York Society of Play’s online workshops. Participant understands that New York Society of Play uses external websites and third-party vendor platforms as they pertain to the New York Society of Play’s online Workshops. Participant agrees that the New York Society of Play is not liable for information that is retrieved or transmitted via the internet or third-party vendor platforms, or any unauthorized charges resulting from a Participant’s use of the internet. 

5. Mandated Reporting

Participant understands that the New York Society of Play’s employees are mandated reporters and as such, are legally required to report suspected neglect that are physically and emotionally evident. Consequently, New York Society of Play’s employees will promptly report any suspected child abuse or suspected neglect which they become aware of (1) as a result of live video streaming from the Participant’s home or other communications related to the Participant’s involvement in the New York Society of Play’s online workshops, or (2) as a result of Participant’s attendance of New York Society of Play’s live in-person programs.

6. Liability Waiver

PARTICIPANT HEREBY RELEASES, WAIVES, COVENANTS NOT TO SUE, INDEMNIFIES AND HOLDS HARMLESS NEW YORK SOCIETY OF PLAY FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, INJURY, ILLNESS, ATTORNEY’S FEES OR HARM OF ANY KIND OR NATURE TO PARTICIPANT ARISING OUT OF STUDENT’S PARTICIPATION IN THE NEW YORK SOCIETY OF PLAY’S WORKSHOPS. THIS RELEASE EXTENDS TO ANY CLAIM MADE BY PARENTS OR GUARDIANS AND/OR THEIR ASSIGNS ARISING FROM OR IN ANY WAY CONNECTED WITH THE AFOREMENTIONED ACTIVITIES.

7. Online Reviews

Participant grants the New York Society of Play permission to use Participant’s reviews for promotional purposes, and to mention highlights from Participant’s activities (e.g. “Thomas went on such-and-such an adventure in Dungeons & Dragons and did this and that”) provided that the real name of the Participant is changed or obscured.

8. Future Changes

This policy may be revised in the future. If a Participant is currently enrolled in any Workshop, then Participant will receive an email notification, which will explain (1) what has been changed and (2) why it was changed. 

Live Program Addendum

1. Allergies and Other Health Concerns

Participant represent that they are physically able to partake in the physical activities and that they have no medical or health or allergy condition that can prevent them from full and complete participation in the New York Society of Play Live Program. If a Participant has an allergy condition, Participant hereby represent and warrant that Participant will take all necessary precautions including but limited to informing other Participant of such a condition in order to safely participate in the Live Program

2. Parent Pickup

Parents agree that they have a duty of diligence and a duty punctuality to the New York Society of Play Staff and other Participants and hereby agree to strictly adhere to the pick up times of the Live Program. 

If a Parent is running late for reasons beyond his/her control, the Parent should promptly contact the office at 347-292-9549. 

3. Photo Release

Participant hereby grants to New York Society of Play, subject to the terms hereof, the non-transferable, non-sublicensable, non-exclusive right and license to photograph or otherwise record Participant, and to edit, use, and reproduce his/her image, performance, voice, and/or physical likeness, as well as  personal information, including but not limited to name and biographical information (individually and collectively, the “Likeness“), in whole or in part, and on a perpetual and worldwide basis, but only in connection with New York Society of Play’s training programs and its content creation and only in promotion of New York of Society of Play’s activities.

Notwithstanding anything set forth herein to the contrary, New York Society of Play will provide prior written approval rights in connection with any usage other than training, content creation and/or promotional activities of the following elements of the Participant Likeness: (1) any and all personal information provided hereunder (i.e., Participant’s name, biography, nickname, and/or other personal facts or information); and/or (2) any and all other pre-existing materials or information not created specifically by New York Society of Play hereunder in connection with the Production (including without limitation photos, videos, and/or other materials, information, likenesses, and/or images).

Participant agrees that all rights in the video(s), recording(s) and/or picture(s) taken of Participant by or on behalf of New York Society of Play specifically in connection with (the “Materials“), including all copyrights therein, shall be the exclusive property of New York Society of Play upon creation. Notwithstanding the foregoing, Participant shall, at all times, retain any and all ownership (and other intellectual property) rights in and to: (1) Participant’s name, biographical material, voice, and any and all other personal information of any kind; and (2) photographs, likenesses, recordings, videos, and/or other images of or including Participant and not taken by or on behalf of New York Society of Play exclusively in connection with the Workshops. To the extent that any and all such pre-existing, or independently created, materials or information are incorporated in the Materials, Participant hereby grants to New York Society of Play the right to exploit any and all such materials or information, pursuant to the terms hereof, but only as incorporated in the Materials (without modification) and not separately and apart therefrom, provided, however, that Participant’s Likeness (or any element thereof) will not be distorted, reproduced, edited, and/or used in connection with another person, entity, concept and/or idea of any kind, in whole or in part, which could reasonably: (1) create a material misrepresentation about Participant’s identity (including without limitation Participant’s appearance and/or biographical information) and/or Participant’s opinions, mores, or beliefs of any kind; and/or (2) disparage or denigrate Participant in any way.

Subject to the terms hereof, Participant hereby waives any and all claims, demands, losses, and liabilities of any kind or nature that Participant may have against New York Society of Play, along with each of New York Society of Play ‘s executives, directors, officers, employees, affiliates, agents, and assigns, with respect to New York Society of Play ‘s authorized exploitation of its rights hereunder, including without limitation, claims in the nature of copyright infringement, defamation, disparagement, slander, false light, violation of the right of privacy or publicity, or the like.

Participant agrees not to enjoin Company’s exploitation of Participant’s Likeness, the Materials, and/or the Workshops in general, and in the event of any breach hereunder by New York Society of Play, Participant shall be restricted to an action at law for monetary damages only.

4. COVID Safety Requirements

Participant agrees to comply with New York Society of Play’s safety requirements which include the following:

  • All participants MUST have at least one dose of the COVID-19 vaccine.

New York Society of Play agrees that it will follow the requirements below

  • All staff must be vaccinated

5. Behavioral Expectations and Requirements of the Space

Most of New York Society of Play’s programs operate within the buildings of other businesses. As such, the New York Society of Play has requirements that must be followed.

Participant is expected to take care of physical property within the program space and to avoid damage to items such as chairs, tablecloths, etc. Participant will not touch or use items that are not provided by our program. 

Participant is expected to stay within the assigned space as allocated by the hosting venue. Participant will not leave this space except for special conditions, such as using the bathroom. Participant will not try to join other tables or activities happening within the space.

Participant understands that shoplifting of any kind is strictly forbidden.

 

Violations of this Paragraph are subject to disciplinary action, including but not limited to verbal warning guided by the Social Contract, communication with a Participant’s parent or guardian and, in serious cases, removal from the New York Society of Play program without refund.

Online Program Addendum

1. Low Attendance Policy

If a Workshop has one or fewer signups, The New York Society of Play reserves the right to cancel Workshop no less than three hours before it begins. If a Participant is registered for a Workshop that has been cancelled, the New York Society of Play will either switch the Participant to a Workshop of equivalent value based on Participant’s request, or refund Participant for the full amount of the Workshop. If a Workshop has only one Minor Participant in attendance after the first ten minutes for any reason, the New York Society of Play will record the Workshop until another Participant arrives, or for its entirety, for security and safety. These recordings are mandatory and will not be used for any other purpose (such as training or advertising). Please see our COPPA Privacy Policy.

In the event of a Workshop has only one Minor Participant in attendance due to last minute cancellations, Participant may elect either to cancel, subject to Paragraph 2 above, or to continue the Workshop.

2. Student/Parent Online Behavior Agreement

Participant shall communicate and behave appropriately, as defined by our Social Contract, with other participants and with New York Society of Play’s staff. 

Participants shall not create or share inappropriate content with anyone involved in the New York Society of Play Workshop, including but not limited to inappropriate or graphic language and images, or engage in cyberbullying of any kind.

Participant shall only communicate with New York Society of Play staff through official New York Society of Play communication means ([email protected], 347-292-9549). Participant shall not communicate with New York Society of Play staff via social media or other personal accounts.

Participant covenant and warrants that he/she will not take or transmit pictures, videos or audio recordings of another participants or staff participating the New York Society of Play’s online workshops, including taking screenshots of live streaming or video communication.

Violations of this Paragraph are subject to disciplinary action, including but not limited to verbal warning guided by the Social Contract, communication with a Participant’s parent or guardian and, in serious cases, removal from the New York Society of Play program without refund.

3. Recording Waiver

As stated in the Low Attendance portion of this addendum, if a Workshop has only one Minor Participant in attendance after the first ten minutes for any reason, the New York Society of Play will record the Workshop until another Participant arrives, or for its entirety, for security and safety. These recordings are mandatory and will not be used for any other purpose (such as training or advertising).

Parents also consent to recording for training materials for our staff. These recordings will not be distributed commercially.

New York Society of Play may use class recordings for marketing and advertising purposes, but only with permission of all families involved in the class. If a video is marked as viable for marketing and advertising purposes, the New York Society of Play will reach out to you and ask for your consent to use your child’s voice and/or likeness in future media.
